WordPress Help Fex Theme

Hi,
I have a custom wordpress theme that I need help with fixing.
This bug was noticed after the 2.8 upgrade.
The scenario is this:
When the comments are turned on in a post, the sidebar rests normally where it should be as seen here:
http://www.the199.com/homebusiness/elite-marketing-center/
Although, when comments are turned off in a post, the sidebar no longer rests in the correct spot and falls below the rest of the post as seen here (scroll down the page):
http://www.the199.com/homebusiness/hello-world/
I need some help fixing it as I can not figure out myself.
